Can your landlord ask you to leave your Dubai home — and if you are a landlord, when are you legally allowed to make a tenant vacate? Dubai’s tenancy law is very clear, and it protects both sides. The rules come from Law No. 26 of 2007 (as amended by Law No. 33 of 2008), enforced through the Dubai Land Department’s Rental Disputes Centre (RDC). Here is exactly when a landlord can serve an eviction notice in Dubai, how much notice is required, and what makes that notice legally valid.
Dubai Eviction Rules — The Golden Rules
- At end of lease: landlord needs a legal reason + 12 months’ written notice
- Notice delivery: via Notary Public or registered mail — WhatsApp/SMS is NOT valid
- During the lease: eviction only for tenant breaches (e.g. unpaid rent 30 days after notice)
- Notice must state the reason for eviction and the vacate date
- Disputes: settled by the Rental Disputes Centre (RDC), never by force or lock-changing
When Can a Landlord Evict a Tenant at the END of the Lease? (12-Month Notice)
Under Article 25(2) of the amended law, a landlord may require the tenant to vacate upon expiry of the tenancy contract for only these four reasons — and only with 12 months’ prior written notice served through a notary public or by registered mail:
- Demolition: the owner wants to demolish the property for reconstruction (with required permits).
- Major renovation that cannot be carried out while the tenant occupies the property.
- Personal use: the owner, or a first-degree relative, will live in it — provided they do not own a suitable alternative property.
- Sale of the property.

When Can a Landlord Evict DURING the Lease?
Under Article 25(1), eviction before the tenancy contract expires is allowed only if the tenant is in breach. The main grounds are:
- Non-payment of rent: the tenant fails to pay within 30 days of receiving a written demand from the landlord.
- Illegal subletting without the landlord’s written approval.
- Illegal or immoral use of the property.
- Damage or unauthorised structural changes that endanger the property.
- Using the property in a way that violates planning and licensing rules.
Even then, a landlord in Dubai cannot simply change the locks — eviction must be filed through the Rental Disputes Centre.
Tenant Rights in Dubai You Should Know
- Invalid notice = no eviction. If the notice is not notarized/registered, does not give 12 months, or does not state a legal reason, the RDC can reject it.
- Personal-use rule: if the landlord evicts to live in the property, they generally may not re-rent it to someone else for 2 years (residential) — otherwise the former tenant can claim compensation at the RDC.
- Rent increases are separate and capped by the RERA rental index — an eviction notice cannot be used to force an illegal rent increase.
- Ejari registration protects both parties and is required for a valid tenancy contract.
