Vacant vs Tenanted Property in Dubai: A Buyer's Checklist
When comparing Dubai homes for sale, look beyond the price, photographs and bedroom count. The property's occupancy can determine whether it suits your plans: moving in, buying a home for later use, or purchasing with an existing tenant in place.
A property advertised as "Rented" can still be for sale. That label describes its occupancy, while "For Sale" describes the transaction. Start by telling the agent which outcome you need and when you need it.
Start with your move-in plan

For a home you intend to occupy, give a target move-in date rather than simply asking whether it is available. For an occupied investment, ask for evidence of the existing tenancy and the property's ongoing costs. The same apartment may suit one buyer's timeline and fail another's.

Confirm the advertised occupancy status
Vacant now: ask whether the unit is physically empty, when you can inspect it and what possession arrangements will be written into the sale agreement.
Tenanted: ask for the current tenancy documents and arrange access respectfully through the agent. Do not plan an immediate move-in from the sale advertisement alone.
Vacant on transfer: ask what documents and agreed conditions support that proposed handover. Treat it as a term to verify, rather than a substitute for reviewing the tenancy and sale paperwork.
Dubai's tenancy legislation protects the existing tenant's rights when ownership changes; a sale does not itself cancel the lease. Article 28 of Law No. (26) of 2007 explains this protection. Dubai tenancy legislation
For the specific end-of-lease grounds listed in amended Article 25(2), the law requires at least twelve months notice, served through a Notary Public or registered mail. Ask for evidence before making an offer
Use this as a discussion checklist with the seller's representative:

- Current tenancy contract and Ejari information, the tenancy dates and contractual rent. Our Ejari guide explains the separate registration context.
- The position on rent already paid, payments still due and the tenant's deposit. Ask how the parties propose to account for these at transfer.
- Any agreed vacant-possession terms, relevant notices or unresolved disputes.
- Included furniture, appliances, parking and any known maintenance obligations.
Record what has actually been checked and what remains to be confirmed. An advertised annual rent or a verbal move-out promise is not the same as reviewed documentation.
View the exact unit and check ongoing costs
During a viewing, compare the unit with its original photographs and layout. Inspect the condition, light, usable space, parking access and included fixtures. Ask which repairs or handover items will be documented. For an occupied home, confirm access arrangements before booking; do not infer the tenant's departure date from photographs.
For apartments, check the approved service-charge information for the correct project and year using DLD's Service Charge Index. The index says its charge figures exclude arrears, so ask separately for the unit's account position and any outstanding sums. DLD Service Charge Index
If your objective is rental income, request the actual lease information and allow for ownership costs before comparing opportunities. This guide gives no rent or return forecast for a particular unit.
Create a clear handover brief
Before committing, write down:
- Whether you intend to occupy the home or retain a tenant, and your preferred timing.
- The occupancy and possession terms to be agreed in the sale contract.
- The proposed treatment of rent, deposits, charges and other transaction-specific balances.
- The furniture, appliances, keys and access items included.
- Which documents, inspections and handover conditions must be checked before completion.

Can I buy a property while it is tenanted?
Yes, an occupied property can be offered for sale. Review the existing lease and transfer terms rather than assuming an empty handover.
Does "ready" mean I can move in immediately?
Confirm both completion and occupancy. A ready apartment may have a tenant.
Can the photographs confirm vacancy?
Photographs help you assess the home. They do not establish its present occupancy or the contractual possession date.
